  • The Future of Life Institute AI and Life (FLI) Ethics Principles:(2017) The Future of Life Institute is a nonprofit organization run by scientists, researchers, and concerned citizens who are dedicated to ensuring that the governance and research surrounding various modern technologies, especially artificial intelligence, do not adversely affect future generations. Their non-profit’s AI and Life Ethics Principles are focused primarily on minimizing potential physical destruction of research and technology or the environment, while also imposing ethical constraints on AI use for military and combat. This emphasis on leveraging the potential for vital roles in real-world problem-solving will be helpful as generative AI continues expanding in real-world research applications.
  • The International Telecommunication Union (ITU) AI for Good Global Summit Ethics Principles: (2017) The International Telecommunications Union (ITU) was founded in 1865 as an intergovernmental mechanism to coordinate international telecommunication and communication-related activities of countries and business entities as well as set international telecommunication standards. The ITU increasingly focuses on the convergence of telecommunications with other domains such as computers, audiovisual systems, and home appliances, ultimately producing solutions for almost any technology-related problem.

The 5 Key Ethical Principles for AI

The five key ethical principles for AI are as follows.

  • Fairness
  • Accountability
  • Transparency

These principles have been proposed by various governments, organizations, and academics working in the field of AI Ethics, including the European Commission (Ethics Guidelines for Trustworthy AI,2019), OECD (Principles on Artificial Intelligence,2019), UNESCO (Recommendations on the Ethics of AI, 2021), and IEEE (Ethically Aligned Design, 2019).

While there is not yet global consensus around the ethical principles that should guide AI, these five are the most commonly referenced by current governance frameworks in an industry with a complicated history of politicization and unevenly governed markets.

  • Fairness: AI systems should avoid discrimination and bias and should treat individuals and groups equally and in a manner that is fair according to societal norms. In generative AI, there is a heightened risk of bias and discrimination which can then spread on a societal level.
  • Accountability: AI systems should have accountability mechanisms or at least transparency mechanisms such that stakeholders can understand the decision-making process and outcomes. This is particularly important in generative AI where outputs can sometimes be wholly incorrect or completely fabricated and users may receive them as credible.
  • Transparency: AI systems should be transparent, both in terms of how they work and the manner by which information is kept by the systems. This ensures users of generative AI have the proper context while using the tools so that they do not reach false conclusions.
  • Privacy: AI systems should have strong security protections that are consistent with the intended purpose of the AI system and the expectations of stakeholders. Strong data privacy frameworks governing input and output data of generative AI is particularly essential as abuse of unique user prompts or sensitive information stored in the system can compound damages if the generative AI output is then misused, copyright infringed, or utilized for fraud or scams.
  • Safety/Security: AI systems should not pose unacceptable risks of harm either when operating as intended or in cases where errors or failures can reasonably be expected. Generative AI has a much greater ability to create large volumes of media, content, or information that is false, misleading, or inappropriate, or can easily be weaponized in the wrong hands.

Because generative AI can undertake such a wide variety of tasks, AI experts including Kate Crawford, director of research at Microsoft Research New York and an academic at New York University, advocate the need for sector-specific regulatory frameworks in addition to the broader frameworks normally used.

When corporate ethics policies are properly implemented and enforced, engineers and product managers receive guidance on the ethical implications of various choices they face as they build AI products, as well as tools to mitigate harm in their outputs.

Technology companies have been coping with the challenge of AI ethics policies for more than half a decade following the release of Google’s “AI Principles” in 2018. Not surprisingly, almost all are in the process of determining how to best implement such policies and create internal governance structures.

Internal ethics committees have been a common first step at many companies. Google and Microsoft both utilized what they called “AI ethics boards” until they realized that external scrutiny of their boards and internal organizational problems made this governance approach impractical.

Unsurprisingly, the following months saw heated discussions within the company on how to implement internal governance structures that would not expose the firm to negative external perceptions. In mid-2020 the company pivoted to a more flexible “ethics review” process that provided a checklist for project managers to think through ethical questions they might not have already considered.

Many other players in the field of AI are developing governance structures. For example, OpenAI’s chief AI researcher shares details on the company’s internal ethics committees and special development controls on extremely powerful and dangerous models. Microsoft made clear its ethics focus when it made a risky investment in OpenAI, in part because it wanted to win a leadership position in the future of all AI development, including generative AI. In their guidance to investors in 2020 around the OpenAI investment, Microsoft specifically mentioned ethics, governance, and compliance.

Similar developments are occurring outside of US-based technology companies. For example, the German government and the European Union are forcing ethics policies on companies via new regulations. The German government unveiled its draft Industrial Strategy 2030 in February 2020, which promised to oblige companies to act ethically, including in the domain of AI. The EU is expected to finalize its AI Liability Directive in early 2024, which will increase the accountability of companies for wrongdoing by their AI products.

Non-compliance with the EU framework both in AI Act and the DSA can have material consequences for corporations in terms of fines (up to 6% of annual global revenues) as well as reputational risk.

The U.S. Bill of Rights defines and describes the roles of the groups involved in AI development and deployment specifically in the context of protecting users against harm and abuse. It maps out specific consumer rights, including the right to protection against unsafe AI, the right to dispute unfavorable decisions caused by AI, the right to know when AI is being used, as well as corporate responsibilities, which include a Fair AI obligation to protect consumers from unsafe, biased, or discriminatory outcomes.

This is sometimes referred to as memorization and can be especially dangerous if it leads to the disclosure of sensitive personal, health, or financial information.

Data governance’s ethical challenge is the large amount of uncurated data on the internet. This makes it nearly impossible to guarantee that proprietary, sensitive, or protected user communications will not show up in subsequent AI output. This was a significant challenge in the early generations of large language models and following their release. For example, researchers have shown that early versions of ChatGPT could easily regurgitate sensitive or proprietary information from past users. This is no longer an issue with ChatGPT’s security features, but could be with other future AI tools. The lesson here is that developers of generative AI do not have sufficient control over the data they train their models on.

With Differential Privacy, only the main parameters of the data are visible, while the actual, user-specific data is hidden. This keeps AI models from memorizing individual user data, while still allowing for relevant insights into user behaviors and preferences.
  • Algorithms for Data De-Identification: Collectively, these methods make derived data much more difficult to link to a specific individual or source due to the changes made to the data’s original values. This may include replacing specific names with ‘John Smiths’, removing identifying numbers and changing other’s, masking locations by replacing them with regional data, and more.
  • Encryption: This technique scrambles the original information contained in a dataset such that it is converted into an alternative code while in storage and transit. Only those with a specific key are able to decode the data and view it as it originally was. This ensures the security of data containing sensitive information. In the context of generative AI, data hackers would potentially be able to see the original user prompts and model outputs, making encryption a vital safeguard.
  • Building in user data protection compliance: Such measures as giving users the ability to delete their information for AI models such as Google Bard and ChatGPT also offered to users, ensuring data protection processes in generative AI and model rises up the corporate structure to ensure that compliance becomes part of company culture.   • Hallucination Evaluation Metrics: Hallucinations in AI models are outputs that introduce false facts or misleading information deliberately or in error. These can be particularly troublesome for generative AI since they can create apparently factual-but-untrue text, images, and other outputs. There is development underway to objectively assess the accuracy of factual claims generated by AI systems and determine how frequently errors occur, according to an extensive Musgrave et al”Auditability and Accountability in Machine Learning Systems: A Survey” journal article.
  • Truthfulness & Reliability Metrics: The reliability of generative AI refers to the trustworthiness or accuracy of outputs which is related to but not always tied to hallucination rates. And since generative AI systems work by sifting through vast oceans of data that include unrefuted conspiracy theories, unreliable social media sources, and more, they can generate unexpected content. To achieve a high level of ethical governance, generative AI strategies must assess outputs to measure and validate whether it accurately adheres to the source material.

The Future of Ethics in Generative AI

The future of ethics in generative AI depends on the evolution of technology and on interactions with changing regulatory environments around the world. We can define these two dimensions of development as IPO, or the Intersection of People and Organizations.

  • Innovation (I): Advancement of AI capabilities and creation of more powerful generative Dupe systems requires evolving ethical technologies and strong internal company ethical policies to mitigate risks.
  • People (P): Personal and social values shape the ethical dimensions of generative AI. We will see a growing demand for ethical products, governance policies, and oversight, but we will also see weakening of scrutiny as users show willingness to sacrifice ethical concerns for the sheer power these generative systems bring. However, the resulting power of generative AI tools means that serious violations of ethical practices will likely get exposed and carry penalties far greater than those for misuse of earlier AI systems.

Public Awareness and Participation:

As information and communications technologies evolve in lockstep with generative AI to create more immersive experiences, consumers’ ethical expectations of these generative AI products will rise. The danger of misuse will heighten scrutiny and involvement of consumers in ethical deliberations at all levels. Human-in-the-loop systems are AI applications in which human involvement is maintained at critical operational points to guide AI decisions and improve outcomes. These systems range from those in which humans simply review AI decisions to much more fully utilized approaches with humans adjusting AI inputs, training AI algorithms, and even assigning final decisions.

Human-in-the-loop systems are critical for ethical AI implementation due to the complex and potentially dangerous nature of Generative AI. With deep learning models reliant on massive datasets, care must be taken in the selection and evaluation of training datasets. Humans are best suited to ensure this ethical consideration is applied to Generative AI. Additionally, humans are needed to provide more holistic situational awareness when reviewing AI outputs to better identify bias or harmful content. Should problems be found with AI outputs or decision criteria, humans allow team feedback to be sent into the Generative AI model to improve it over time.

Importance of Ethical AI Research Communities

Ethical AI research communities are collaborations and consortiums of academia, industry, civil society, and governments that come together to explore different facets of AI ethics and develop guidelines. They play an important role in sharing knowledge and best practices, developing solutions and guidelines for improving generative AI, and holding each other accountable.

These communities increase stakeholder awareness and invite their participation in the ethical discourse around generative AI and its impacts. Decision-makers and technology leaders are often unaware of a technology’s negative side effects until they have manifested in society. Ethical research communities encourage diverse perspectives on ethical AI challenges, inclusively surface and explore a greater range of potential issues, and develop potential responses to those issues.

Non-profit organizations have led the establishment of ethical AI research communities. The Partnership on AI, an organization of leading AI companies and research institutions in North America and Europe (including Amazon, Facebook, Google, IBM, MSFT, and Apple amongst its founding members), has focused efforts on AI safety and AI’s impact on society. Since its inception in 2016, it has published many research papers and guidelines focused on strengthening public understanding of the technology, identifying biases, creating standards, and addressing ethical challenges.

For example, the Partnership on AI published guidelines for dealing with risks associated with algorithmic decision-making, and the AI Now Institute at NYU has been working to advocate for greater algorithmic accountability in the public and private sectors, with a particular emphasis on AI’s impact on marginalized communities.

Another example is the IEEE Global Initiative for Ethical Considerations in Artificial Intelligence and Autonomous Systems. This works to identify best practices for developers and technologists working on AI so that the principles of ethical First AI are integrated into these technologies and their development processes. The Institute has focused on ethical issues across a very broad range of technologies and has published standards and frameworks, as well as a study on autonomous parking lot systems that exemplifies the different ethical challenges that drive these technologies.
